FAQ
Personal Injury and Accident Claim - Common Questions
-
How much will it cost me?
If you choose to put your claim through a Claims Management Company, be careful, some will charge you a percentage of your compensation as well as selling your claim onto a Solicitor you have never heard of and know nothing about. We always recommend you deal directly with a personal injury Solicitor who is regulated by the Law Society.
-
How long will my claim take?
The average claim should take between 6 to 9 months. However, this will depend on how quickly your injuries heal, whether there are any disputed facts relating to the accident which have to be proved in your favour and the complexity of the issues involved in your particular case.
-
Will I have to go to court?
This is extremely unlikely. There are clear protocols in place to ensure that claims are settled through negotiation where possible. The vast majority of injury claims are settled out of court. Court action may be necessary to ensure that you are properly compensated if settlement negotiations break down, but the chance of you having to go to Court is less than 1%.
-
What happens if I LOSE my claim?
If, for whatever reason your claim is unsuccessful our costs will be written off, you will not have to pay a penny.
-
How much compensation will I get?
Compensation varies from claim to claim. As every case is different, the amount you are likely to receive for a personal injury claim depends on a number of factors, such as:
● The nature and severity of your injuries
● How long it takes you to recover
● What effect the injuries have had on your life
● The financial loss you have suffered as a result of the injuries e.g
● Loss of earnings, including overtime and bonuses
● Travel to and from medical appointments
● Any medication
● Care given by members of your family
● Damage caused to any of your personal effectsThere are many other items, which we will discuss with you. If you are still suffering as a result of your injuries, it is not possible to determine the exact amount of compensation you will receive but our personal injury specialists will advise you based on their considerable expertise and experience.
-
Can I receive help with treatment costs?
These days you do not have to wait for the end of your case before receiving financial assistance to help you get better, faster. Where responsibility is accepted for your accident, we can arrange private treatment for you to be paid directly by your opponent, or we will negotiate early payments for approved treatments.
-
I think I am partially responsible for the injuries I sustained, can I still claim?
Yes. We will fully investigate the circumstances of your accident and will advise you whether you are partially responsible or not. Even if you are partially responsible, this may only reduce your award by a small amount.
-
My accident happened over a year ago, can you still help?
Yes we can, normally we can only help if your accident or injury occurred less than 3 years ago. There are certain exceptions to this, so please contact us straight away. The sooner we hear from you, the sooner we can settle your claim.
-
I have a car accident claim where the other person is uninsured, can you still help?
Yes, even if the other driver was not insured, we can help you to claim compensation from a state scheme called the Motor Insurers Bureau.
-
I have already received an offer from the insurance company. Why do I need to use a solicitor?
Make Your Injury Claim will provide you with clear advice to ensure that we obtain 100% compensation in a reasonable timescale. You can of course bring your own case and attempt to claim personal injury compensation and losses through the courts or by dealing direct with the insurers. There can be complex negotiations and paperwork to be dealt with, and if these aren't handled correctly it could potentially jeapordise your entire case.
It is estimated that insurance companies are now dealing with up to 20% of claims through contacting and dealing with the injured party direct. In some cases there is active discouragement to advise people to seek independent legal advice.
Make Your Injury Claim believe that you should receive high quality independent legal advice. We do not consider that an insurance company can provide fair and impartial advice to an individual in attempting to settle their claim, whilst at the same time acting on behalf of the interests of their policyholder and indeed their shareholders.
If you deal directly with us instead, it won't cost you a penny. In addition, we know and understand the personal injury claims process inside out, we are also regulated by the Law Society for your own peace of mind and protection. We have expert Personal Injury Lawyers with countless years of experience in dealing with Accident and Injury Claims who can negotiate and deal with the defendants on your behalf.
After an accident it is essential that you take the time to rehabilitate and recover properly. By using the services of a reputable personal injury solicitor you can let us take the burden on your behalf, which leaves you free to concentrate on the road to recovery.
